Nonpayment of penalty for delay in possession of flat

I had booked a flat in April 2010 with Creative Environs Builders and Developers. I used down payment plan since they had advised this flat will be complete by Aug 2005. In information they had provide writing presentation dissimilar milestone and shown April 2010 as the last day.

In the residence buyers guide they had mentioned they pay Rs 10 per sqft per month as punishment charges in case this project is not delivered for ownership for 2 years.

Last week I had lastly acknowledged the ownership letter which is good 3 years and 2 months from booking. Now Shree NILAYA is not willing to pay the penalty. I will appreciate any help you can extend. Thanks,
