1.    I am a member of defense force who purchased a unit No 302 in T-6 SAVANA, in greater Faridabad project in year  Dec 2005 from RPS builder(RPS Infrastructure Ltd) for which he has offered possession on 25 Jul 2014.


2.   But the builder has neither attended nor resolved the issues leading to denial of justice under right to information Act 2005 and consumer protection Act 1986.

  1. The builder has charged an enhanced EDC of Rs 1, 41, 910  wef 10 Sep 2011, whereas the case is still pending in the Punjab and Haryana High court. He has compelled me to pay the amount against 24% interest with threat and time constraints.  Thus it has incurred loss to me by discrimination and not refunding the amount.

4.   The last payment I had asked to forward a consolidated payment plan with the penalty amount as his right to information. But he neither refunded the penalty amount nor adjusted or apprised the buyer how he would like to do it, leading to a situation where   customer is kept in  dark in spite of repeated reminders. We have clearly brought out that the penalty amount is far exceeding the installment due and the payment has to be made vice versa, by the builder.

  1. Rather than solving the issue, his office had further complicated it by using the above incident as a base for denial of penalty amount. As per mutual agreement, there is no such clause specified in clear terms. There is no correlation between buyer installment   payment  vis- a- vis  penalty amount  payment  by  the builder. There exits standard guidelines and instructions of High / supreme court where for non payment of installment the buyer pay 18% int(24% in your case) and for delay in penalty the builder pays 18% for the delay period( Rs 5/- pet sq ft in your case). So there is no reason to hold penalty of the buyer.

6.  RPS has not bothered to  amicably resolve the issue  by refunding his appropriate amount so I have been forced to take up the matter to consumer court to kick this builder
